BLOG Extra!!! Salt of the Earth

The following post is from a BLOG called Joe Worker. Joe Worker posted the words of the great Rolling Stones Song "Salt of the Earth" I thought I would post it here for our audience. Solidarity to our Brother Joe Worker from the north country and our thanks.

"A sad September rain is drowning out the life of the day.

I think I 'll head down to Wally's in a bit and have a few drafts with the boys. No doubt I'll drop a quarter in the juke for the Rolling Stones' ode to the working man, 'Salt of the Earth'.

Starting today I'll give a shot at getting my thoughts out here into
cyberspace. I am a working man and damn proud of it. That is where this blog is coming from. But for now, I'm off ... Let's Drink!

Let's drink to the hard working people
Let's drink to the lowly of birth
Raise your glass to the good and the evil
Let's drink to the salt of the earth

Say a prayer for the common foot soldier
Spare a thought for his back breaking work
Say a prayer for his wife and his children
Who burn the fires and who still till the earth

And when I search a faceless crowd
A swirling mass of gray and
Black and white
They don't look real to me

In fact, they look so strange
Raise your glass to the hard working people
Let's drink to the uncounted heads
Let's think of the wavering millions

Who need leading but get gamblers instead
Spare a thought for the stay-at-home voter
Empty eyes gaze at strange beauty shows
And a parade of the gray suited grafters

A choice of cancer or polio
And when I look in the faceless crowd
A swirling mass of grays and
Black and white

They don't look real to me
Or don't they look so strange
Let's drink to the hard working people
Let's think of the lowly of birth

Spare a thought for the rag taggy people
Let's drink to the salt of the earth
Let's drink to the hard working people
Let's drink to the salt of the earth

Let's drink to the two thousand million
Let's think of the humble of birth"

JH 62 More Batgate?

The Joe Hill LTD Project
More Batgate

An ATU member sends us the following. They prefer to remain anonymous.:

remember the iran hostage affair back in the days of jimmy carter?
nightline was born and ted koppel became an instant news headliner 25 years ago
and is still going strong. the joe hill project was born out of the
ltd union hostage affair and joe is an instant celebrity. just as koppel
began to tackle other urgent issues, joe has weighed in on the batgate
incident.

all stories have more than one version. this is a story of a union brother's story opposed to a union sister's story. up until now most have only heard one side and say what's the big deal? in all fairness to both sides (ltd management excluded) need to be made public. i and others have heard kay tell her side and it is quite a
different picture. one thing i will say is that she mentioned that
if the incident had been prefaced with an explanation that "this is for
demonstration purposes only" the outcome would have been quite different.
i ask that your chosen representative speak to her privately to hear
her version and frame of mind and report it as you feel. fair and
balanced, you know the drill. for obvious reasons i don't want to be
identified with this information.

yours in solidarity and fairness,

Joe does not have a chosen representative. Joe represents himself and the Staff of the LTD Project. Joe get quite a bit of email most of it anonymous and unpublished. Joe has not "weighed in" on the Syd Jacobson matter. The Joe Hill LTD Project has reported and has provided a venue for Syd's version and for all to read Syd's own version. If Kay has a different version she can also write to the Joe Hill LTD Project and let her version be read. If a manager dares leave a comment to the BLOG then readers would see that too.

Joe Hill has 1) suggested that Syd apologize in writing for any misunderstanding Kay may have had, 2) Joe Hill has suggested that the management not have a rush to judgment, 3) the incident deserves and should get a full and fair investigation - 3 instructors were in the room with at least 8 other drivers who were witnesses, 4) Joe has suggested that Syd may be on on the bosses shit list as this is something that happens at LTD and 5) Joe has asked that Slava Lubamudov, The Joe Hill LTD Project "Pole" Worker's to conduct a poll as to whether Hammbert's golf clubs are any less a weapon than Syd's bats. Brother Anonymous really should get the story straight on what the Joe Hill Project has done on this story.

On Wednesday at 4:00 PM, my guess is that Syd will be getting his final pay check when he meets with the bosses - and that would be bad and it would be wrong! The Union cannot let this stand if this happens. An injury to one is an injury to all and the bosses look for every way possible to fire us simply to keep us down. Never forget this!

Thank you Joe Hill. I, RoseAnn Roseannadanna, have always been a union member and I, RoseAnn Roseannadanna, am proud to support the union effort everywhere.
But Joe, its like my daddy used to say "You know, its always something." The Joe Hill LTD Project looks like to me, RoseAnn Roseannadanna, that you may have overstated the problem of the Payroll Issue in JH 61. What's the matter with you Joe! A few cents here and few cents there, big deal. But hundreds of dollars? And as I, RoseAnn Roseannadanna always say "I, RoseAnn Roseannadanna don't think so!" How can you use this example when not one of the checks that we have at the Joe Hill LTD Project reflects the kind of error rate that you lead some to believe. But I, RoseAnn Roseannadanna, agree with your advice to always check your check.

>Joe...thanks so much for your hard work in exposing the rampant corruption and mismanagement at LTD. I am sorry to be slow in putting a comment in to the site as I have been wrapped up in these presidential politics. I found it particularly insightful your remarks about the LTD board lacking diversity (and the inability to question the spoon fed pablum they get from Hamm and company) and thoroughly applaud your letter to the governor. I think that at this point, Rep. DeFazio should get your letter and that the media ;ie Eugene Weekly, should be aware of the problems that you have so magnificently pointed out.
>Some of my first thoughts when I was reading your commentary on BRT was that it had too much political momentum to stop. But the more I thought about it, I realized that this is a big ego trip for LTD management . I do value the idea of innovative ideas for mass transit but this particular project needs to be put on hold until secure funding is available (monies not made off union brothers and sisters backs). Our present state of the economy, both regional and national, dictates that these projects be iced until later. I think we need to get our ridership (guest is not in my vernacular) informed that gaining 3 minutes time will probably result in reduced services in order to fuel the egos of LTD management.
>In the past I was willing to give management the benefit of doubt but with their initial contract offer and your educating papers I will fight until we get competent management at the helm.

JH 61 Hammbert is Playing with Fire

The Joe Hill LTD Project
Hammbert is Playing with Fire

You know that Pay Roll Issue that you have heard about? You really should not think that it is a small thing. We all work for pay not the joy. Even Hammbert works for pay not the joy. You will recall that Brother Dreier reported that 75% of his paychecks had errors in his checks since about the beginning of the year. There was one check that had two errors. Let's analyze this and what it might mean and why an audit is necessary.

    • Our top hourly rate of pay (without longevity) is $18.45 per hour
    • There are normally 5 work days in a work week.
    • Lets say that over your time in the week your pay check is shorted only
1/4th hour per week or 15 minutes per week (five or so minutes per day)
    • Number of pay periods not paid

The calculation is then something like this:

(hourly pay / 60 minutes) x days x minutes not paid (5 minutes in our example) x 20 pay periods

(18.45/60) x 10 days x 5 minutes x 20 pay

periods =

Our result is = $307.50 and if it is over time then
multiply by 1.5 and you get $461.25!
And the year is not even over yet.

Hammbert Playing with Fire

This is not a minor issue! It adds up over time. It is the same amount that LTD wants to take away from the union for prep time. They think it is very important. You know what we should keep it very important too. In fact, maybe these potential shortages are intentional because they oppose the prep time gain we got in the last contract. I have given my information to the union and you need to do it too. Always check your check - that's why it is called that you know.

BLOG Extra!!! Syd Explains About What Happened

TO: All Joe Hill Readers

Syd sent this to the Joe Hill Email Address so I presume he has no objection with me posting this. Some thoughts... I think that if baseball bats qualify as weapons then the golf clubs in Hammbert's office qualify as weapons as well. The Fumes have had softball equipment at the property before without any problems. But if you are on Mark Johnson's or Rob Montgomery shit list then I suppose a frown or an off stare qualify as a weapon. Syd, say you are sorry to Kay if she misunderstood and tell then them to get real, or you may be the next staff reduction for the fall schedule.

Subject: Misunderstanding at Fall Training

I was approached by Sue Quick, a supervisor, in the fall training class Friday, September 24, 2004 at 17:02 where we had just broke for lunch. She emphatically said that she needed to talk to me right now and to bring all my things. She looked very serious and I wondered what this was all about. This was said in front of other classmates.

We walked back to Mark Johnson’s office where Kay Kinnish, another supervisor, joined us and I was told Walt Boynton would be here as my union representative. Sue proceeded to ask me about my threatening behavior in class toward my fall training instructor, Kay Christopher, involving a baseball bat that occurred about an hour and a half earlier. It was also mentioned that I had brought a weapon to the workplace. I was completely stunned and caught off guard with the accusation to think that my intentions in training class had apparently been grossly misunderstood. I knew we would be discussing safety and heightened security issues in mass transit.

The reason I brought two baseball bats to class was to facilitate a conversation, at an appropriate time, about weapons or potential weapons that can be carried on the bus (my work station). Just the sight of a common child’s bat can be unnerving. I was merely using the baseball bats as props to represent a household item that could be misconstrued as a weapon and potentially make some people uncomfortable, both on and off the bus. Apparently my example made about ten times the impact I was anticipating. I had asked Kay Christopher if it was a weapon, she said "It’s a bat." She showed no visible outward signs that she was stressed or troubled. The bats were clearly visible in class the entire time since we started at 12:00 o’clock. People saw the bats being carried to the classroom before it began. It was no secret. I believe everyone in the room saw them. At no time did any instructor question my motive for them.

Our training sessions have a history of using props to make points. In our class there was a fake bomb up on a ledge in the southeast corner that looked real. Some people were made to feel uneasy with this prop also. I had actually hoped to open dialog with Ken Hamm about LTD’s policy of no weapons or pepper spray being allowed to be carried by operators, but are carried by customers. He was unable to attend class as scheduled. When Kay Christopher asked me directly during class "Okay, Syd, so what’s with the bats?", I took my que to walk up in front of the room with her and address my issue to the class. I am not a teacher, instructor or experienced public speaker. I may have been a little flushed feeling because Sue Quick later mentioned to me that I was "red faced." Anyone who has worked around me could tell you I almost always wear shorts and am a very warm blooded person. "Red faced" is common for me.
I said a few sentences about my feelings of vulnerability at work (with the bat outstretched in front of me, hanging onto it near the middle) and being trapped in the driver’s seat. I expressed my desire to change the policy regarding pepper spray. After I finished, Kay said she would be more comfortable with the bats up front, so I handed them to her and returned to my seat. This all took place in less than two minutes. It was a loosely structured class where people were encouraged to chime in, ask questions, be involved. The class continued on like nothing out of the ordinary happened.

I assumed, as I believe the other classmates present believed, that a good point was made. I never raised the bat up to my shoulder or ever hung on to it by the handle as if to swing it. At no time did anyone tell me to sit down, or get away from them, or that I was scaring them. Nothing negative was said to me at all. I never threatened or meant to intimidate the instructor personally nor would I do something like that. I was merely trying to add a meaningful example of how the presence of a simple item can create uneasiness, for debate purposes in the classroom. I assumed this was the proper venue for this discussion.

I feel very badly that Kay Christopher apparently mistook the prop display to be personally threatening and I would publicly apologize to her if it is deemed appropriate. I am deeply saddened and disappointed that anyone could think that I would go "postal" at my workplace and hurt another co-worker. This is very troubling for me. I did respect her as a good instructor and was enjoying participating in the class. I sensed no change in the climate of the atmosphere and assumed that I was not out of place to speak. I value my job and was trying to add to the quality of the training.

At the conclusion of the meeting, Sue Quick said that I was being put on paid administrative leave pending further investigation. I mentioned to her that we were hurting for drivers with the game tomorrow, and I would like to continue driving while they looked into things further. She said absolutely not and to go home now. Apparently emergency status was declared because Jim Stinson was force canceled with less than 24 hours notice. Sue Quick seemed to enjoy being very mean spirited toward me which I mentioned to her. Also, there was discussion between Sue and Walt that I would need to be paid overtime for football already scheduled to drive on Saturday (Football #7748).

I hope this matter can be resolved quickly as I am anxious to return to work and would like an opportunity to complete another training session. Thank you.

Re: Conditions at Lane Transit District

I am writing you to share my concerns about the worsening conditions at Lane Transit District. My foremost concern is the lack of diversity found in the makeup of the Board of Directors. To my knowledge, no one of color or ethnic diversity has been appointed to the Board. It also seems that LTD management likes to handpick business people from the community who never even ride the bus system except for the occasional "dog and pony" show for candidates for the Board. In fact only one Board member at present is a regular rider who did confide in me once that he was reluctantly going to serve a 3rd term because no one else could be found who was a rider of the system. Does this not seem odd to you that with all the workers and university people who ride the bus on a regular basis that no one could be found? I urge you to delay appointments for the upcoming 3 vacancies and consult with labor groups about potential candidates for the Board.

Another concern I have is that the Board has allowed LTD management to misspend monies resulting in extravagant waste of taxpayer dollars. The purchase of untested hybrid electric busses that now sit unused in the bus yard because they had continual problems and spent more time in the garage than they did servicing our riders. Now LTD management has shipped one of these busses down to California to see if a company there can resurrect it from the dead while they have wasted $2.6 million of taxpayer money. The next boondoggle coming down the pike is the BRT system guaranteed to save 3 minutes riding time at the tune of $5 million dollars a mile! I'm all for alternative transportation systems but this is one system that needs to be put on hold until the financial mismanagement has been sorted out. My suggestion is to fire the whole Board of Directors is as your prerogative and appoint a new Board that is more representative of the ridership.

Our once "world class" bus system has again suffered a service reduction because management, with the Board's acquiescence, is raiding the general operations fund for non-functional equipment and untested transportation theories. Why should a Lane County company provide the LTD payroll tax when its workers cannot be guaranteed to get to work because the bus system has once again cut its hours?

I am an employee of Lane Transit District but am not submitting my name due to the fear of reprisal. I urge you or a representative to look into the problems of our district and to take corrective action. Thank you for your time.

JH 60 Bombs, Bats and Balls - Play Ball!- Play Ball!

Joe Hill LTD Project
Bombs, Bats and Balls - Play Ball!

There is a time and a place for everything. Bombs, Bats and Balls - Play Ball! The Hallmark of leadership is knowing when to use any of them. There are many things to get pissed about at LTD but the story that I heard about the security portion of the fall training is not one of them. First, Kay Christopher is teaching what she was told to teach. Fortunately, the training program has a real strong involvement from union members from John Dahl to all of our other trainers and they all do a great job. Now I have to admit that I do not have any first hand information about what happened Wednesday and Friday but it was all the buzz today at the shuttles. But there are a couple of things that I am sure of. It just does not seem right to bring a baseball bat to a training program for purpose of demonstration.

You see a baseball bat is not a difficult visualization for me in a discussion. The demonstration seems a little over the top and frankly reflects poorly on all of us. I really hope that the Bosses recognize the degree of concern and vulnerability that those of our brothers and sisters that work at night are feeling. Fear is a real element of this service and it seems just not enough to say "don't worry be happy". I really hope that the Bosses don't over react in this instance. They need to be fair and evaluate what happened and recognize this as a sign of concern about the isolation that night workers face. Also, I am happy to be getting this training information of being careful and observant.

I also don't think that as some have said "let us carry pepper spray or some other way to defend ourselves". I think this wrong and dangerous. Remember if one person carries a weapon then all have to carry a weapon. If we all don't have weapons when some of us do then those that don't have weapons are even more vulnerable, because the aggressive behavior will become even more intense as the aggressors will expect a larger defensive capability with a weapon. It just makes it less safe overall. Police officers also require 4 to 6 hours of training in the use of pepper spray. When would LTD do that! Also pepper spray has been responsible for some deaths. In addition, in an enclosed environment like a bus, many innocent people and children could be injured or affected by the pepper spray, not to mention the driver who elects to take such a foolish step.

If there is a legitimate concern about the safety by employees and the isolated conditions that they work in, then there is a better remedy. Really there is.

Call OSHA 1-800-922-2689. LTD has a legal responsibility to provide safe working conditions for all of us. OSHA does not respond only to incidents. OSHA can also be called in response to addressing risk reduction. There are many requirements in the law about workers who work alone and how quickly they will be responded to in a crisis or emergency where their safety is concerned. There is also what is called the "general duty requirement" to provide a safe and healthy work environment. Concerns that are raised must be examined and determinations made. Now this is a much better tactic than bringing a bat to work.

Now if I were the major leaguer that came with their own bat to the game Friday Night, I would be busy writing an apology to Ms. Christopher and the anyone else that was concerned about this. Then I would get on the phone to OSHA and air my concerns about safety. I would do that right away because it is the right way.

Bosses you need to accept this as a wake up call too! It sounds like to me that we have been lucky so far in talking to the night crew. Do something about make these jobs safer and do it soon.

In solidarity,
Joe Hill

JH 59a More on Ridership Increasing

The Joe Hill LTD Project

This comment was left on the last post to the BLOG and deserves a front and center response.

At 9:02 AM, Anonymous said...

Please! don't forget the folks at customer service, they too are on the front lines just as much if not more then the drivers. They always seem to get left out of the recognition. Thanks

At 11:22 AM, Joe Hill LTD Project said...

You know sometimes you just can't see past your nose. Even Joe Hill has this problem from time to time. Customer Service Employees do deserve credit for the increase in ridership. Think about it. They are assisting people on the phones to figure out our system. They help riders adjust to the reduced schedules. They sell fares and serve the public in polite and professional ways. Lets not for get the facility itself. Customer Service people are at the station with Diane Peterson keeping the facility safe and clean - two major elements of rider satisfaction.

So I don't get in trouble with the Maintenance - you too deserve credit for ridership increases. The buses are more reliable because of maintenance and road calls are fewer. The buses are cleaned by a very dedicated crew with one of the worst work schedules at LTD. Rarely are the cleaners recognized. The GS Workers who fuel and wash buses - I will bet most of us don't even know their names. We thank all of these wonderful workers for your dedication and commitment to work. The ridership increase is our proud accomplishment in spite of management's bad decisions to cut service.

The fact is LTD does not reconize any of the Union workers as being responsible for success. Hammbert says he is trying to create Team LTD - well Goofy, we had it long before you arrived at this great place. Your efforts to make us Disneyland are failing and you should look to the team that you had before you set about to destroy it by creating one in your image.

And so that we don't forget, these ridership increases are increases compared to last year, a down year from the two previous down years. We are climbing out of the hole but not because of Hammbert and the managers. It is we, the workers who are making the difference.

JH 59 Ridership Increasing

Joe Hill LTD Project
Ridership Increasing

It has taken four months for LTD to post the performance reports on their website so that taxpayers and employees can know how good their mass transit system is doing. But the stats are there. LTD Ridership is up and up by quite a bit for June, July, and August.

What are the reasons? Why did ridership go up? I have four main reasons to suggest. The first reason and most important is the professionalism of our drivers. Their continued high quality service that we provide our CUSTOMERS (this is not Disneyland, although Goofy has been sent to us). We can all be proud of this.

Reason Two: What ever economic recovery that has occurred in Lane County has resulted in lower pay for workers in their new jobs. We are no different than the rest of the Country in this regard. Simply put, these lower paying jobs are putting more people in our seats.

Reason Three: The price of fuel that remains stubbornly high. Folks I think we will be living in the light of two dollar gas for a long time to come. The war is causing the oil spot market to flutter all over the place depending on the terrorist attacks. Oil is getting in shorter and shorter supply as China's demand for oil increases. Scary times about oil for sure.

Reason Four: Lets give credit where credit is due. Marketing has done a nice job in their advertising. We are present in the market and that has helped without a doubt. Why did it take years for LTD to get back to this in an aggressive way. It also should be a credit to our union members who played starring roles in the TV commercials. Good on ya.

Now if we stopped that stupid BRT project and restored service coupled with the new station in Springfield, LTD could take off. But this would be way too smart for our management.

BLOG Extra!!! Hammbert Has Loony Plan

Investigative Reporter for the Joe Hill LTD Project, Matt Dred has been on assignment covering the Pay Roll Issue ever since it was brought to the attention of the the Joe Hill LTD Project. Matt was able to get a copy of a tape which purports to be a meeting between Hammbert, Hekelson and Pangbert. The quality of the tape was bad but we were able to get a few bits of information out of the tape:

Hammbert: Diane can't we use all those canadian dollars that we get in the fare boxes to settle this payroll issue?
Hekelson: I know that we have about six thousand of them. I don't think that any of the drivers will know much about the exchange rate... I think this is a great idea..
Pangbert: yeah yeah... they are dumb drivers - I should know, I have been tallkin' to them.
Hekelson: This way we save about 35% on the dollar and the best part is we got these coins in the fare box.
Hammbert: Yeah this is great - I will have graphic design (inaudible) envelopes that I can drop in each of their mail boxes or do you think that I should had them out personally?
Pangbert: No we better have Johnson do it, cause of the chain of command stu..
Hammbert: but I am the boss around here.

The Canadian Dollar
also known as the Loony
Hambert: Can you guys hang on a sec...
(You can hear on the tape Hammbert picks up the phone and dials)
Hammbert: Hello is this Oakway.. good good...Tee time for Friday? Hmmmf. Nothing earlier like 2:00 PM. Oh 1:45 will be fine ..no I am a single you can match me up. Thanks see ya. Bye
Pangbert: So we have decided?
Hammbert: Yes I will be golfing on Friday at 1:45.
Pangbert: Right, I mean on the Canadian Dollar replacement plan?
Hekelson: I think we can do it.
Hammbert: Well lets get it done I cannot stand whining about pay. If they don't like it then we can see them in court!
Pangbert: You mean arbitration
Hammbert: Whatever....
Brothers and Sisters we have a real problem.

The Joe Hill LTD Project
Pay -Shortages Looming as Powder Keg Issue who will be accepting the responsibility for this?

Maybe Ken Hamm should have taken a moment to check with Diane Hekelson and see if she was shorting the pay of union employees before his inappropriate and impulsive degrading behavior. Instead Hammbert in his usual superior arrogance sends his symbolic dollar bill to insult one of our fellow members. Excuse me! What is the symbolism we should conclude from this vicious act. Answer: that we need to know our place. We should be saying "Thank you Mr. Hamm, oh thank you sir," as we tug at our fore lock of hair. It is like a scene from Oliver Twist.

Instead of this disgusting vision we should demand an outside independent audit and get the money they owe us.Where is the Board of Directors? Can't they control their "bull in the china shop" General Manager? His record of lack of accomplishment is shocking. Three years of declining ridership. Service reductions in each fall of the last three years. Ever rising costs of the BRT beast. And the ill fated decision to charge us for health insurance that an arbitrator wisely and correctly pointed out was in violation of our contract. Then wasting $2.5 million on worthless AVS buses (even though Pangbert took the fall for this huge mistake) the buck must stop with Hammbert - after all he is the one handing out the buck in his disgusting and insulting way. When is the Board going to recognize that the General Manager is wrong for the proud traditions of LTD. The Board needs to wake up!

Hamm sits on big pile of money and cheats workers.
Don't trust LTD!

Union members get your pay stub's out. Check them closely. Do not trust the LTD Hammbert answers. Hekelson is definitely over her head on payroll issues for union members - or maybe its just a bias. I will bet you that no administrative employee ever had their pay shorted regularly. Following the union meeting this week Dan Dreier posted this on the Joe Hill LTD Project Blog -

"...The issue of short pay came up at the union meeting. I went home and checked my statements for the year. Out of 19 checks, I found 20 mistakes in 16 of 19 statements. (Just multiply your hours by you rate of pay.) ..."
In Solidarity,
Dan Dreier
This is an overall error rate of 118%!!!! And an error rate of 75% for checks issued to Brother Dreier. In other words only 1 in 4 checks that are issued to Brother Dan is without an error. And for every error check, 1 of 8 will likely have more than one error.
If you went off route that many times in 32 weeks do you think that you would still have a job? If you got this many customer complaints in 32 weeks do you think you would still have a job? If you stole this much money from LTD in 32 weeks do you think that you would still have a job? Our jobs require precision in many ways. Precision is demanded from drivers when reporting for duty. If you're even one-second late it could cost you a days pay. What about being late 75% of the time. I don't think so. If you are one-second late after a holiday, you forfeit your holiday pay. If you're one-second late and are on a letter of warning or suspension for previous lates, it could (and in some cases has) cost you your job. Should LTD's precision in our pay be any less? Do you think it is ok for LTD to steal from us at this rate in 32 weeks? I have heard the same old "rounding" excuse for my own paycheck way too many times. But I am not going to let it slide anymore and neither should you.

I am glad that the Union is going to grieve this but LTD is not only violating our contract. LTD is breaking the wage laws of Oregon. Maybe we should also file wage claims with the BOLI where penalties and interest may also be owed.

You know, I don't feel like a "family fun day" if my pay is wrong or in doubt. I just can't imagine having fun with Hammbert. And as long as Ken Hamm is cheating our pay do you think I will trust him with a fee for golf. Forget about it! - besides how appropriate is it that we should be funneling money through private persons for what is an supposed to be an LTD event? I wonder how much Ken Hamm or Mark Johnson will rake off the top? Maybe free green fees for the organizers?

JH 57 Mark Pangborn Admits Responsibility

The Joe Hill LTD Project
Mark Pangborn Admits Responsibility

An unusual circumstance happened on September 21, 2004. Mark Pangborn or Pangbert as we like to think of him, admitted that he was responsible for the AVS fiasco. When he was asked directly by an employee who was responsible for this error in judgment and management, Pangbert raised his hand and accepted the responsibility. He said he was accountable. Wow!

I think that this was so kind of Mark Pangborn to
take the gaffe for this.

The employee then asked what the consequence were for this big mistake. Pangbert said "What do you think the consequences should be?"The employee said (bravely and honestly) well I think you should be fired.

Pangbert got visibly angry but returned quickly to calm resolution. So calm that instructors had to ask Pangbert to speak up.
Joe Hill's advice to this brave employee is lay low, because even when they say any questions are open for discussion, they really don't mean it.
Let's face it... we do not live in the age of management responsibility. Kenny Boy Lay can steal millions of dollars from Enron and not face any consequences. Why shouldn't LTD management get a free ride if not even a rewarded ride for their blunders; everyone else does in today's business world.
It is arrogance to claim responsibility and then not think their should be a consequence for bad decisions - especially with public funds? What do you think. Here is your chance to say in our next free poll. It is as follows:
Mark Pangborn has admitted that he is responsible for the AVS bus financial fiasco to a group of LTD Employees. What do you think should be the consequences for Mark Pangborn?
O He should be fired.
O He should be required to refund the cost to
the taxpayers for their loss.
O He should be demoted.
O Nothing should happen.
O He should receive praise for good work.
O He should be praised and receive the
maximum merit pay for his position.
O Other ___________
Here's your chance. Click to the link below to cast your vote. As always your vote is secret and anonymous to all, so have some fun and vote. Remember vote early but NOT often - Only one vote to a customer! Bet you can guess what the real consequence for Mark Pangborn was -- Ca-Ching Ca-Ching!

Timing is Everything

The LTD Bosses decided to have a free day on the LTD System for the grand opening of the New Springfield Station...oops we mean the milestone of Springfield installing a new traffic signal on A Street. Great planning guys. Hitting that time bullseye is such a hard thing to do, huh? By the way the phone number for the Springfield Traffic Signs and Signals is 726-3761. You might give them a call next time you think of having a free day for a traffic signal in Springfield. They may be able to tell you exactly when things are happening.

We here at the Joe Hill LTD Project have heard rumors that Springfield is building a statue to former City Councilman Fred Simmons and retired LTD Driver. Please LTD lets give the riders a free week for this wonderful milestone when it happens.

The Joe Hill LTD Project has also heard that Springfield is installing new manhole covers on 14th Street between A and Main in November. LTD should have a free day for this incredible milestone. Lets celebrate! How about a GM Barbecue for this milestone. What do ya say?

Are we ready yet?
Next week they are planting cattails in the bio-swale at the new Springfield Station. What a milestone - another free day - oh please.
And when the New Station does open in October or November maybe LTD should have a Free Fare Year. It will be cheaper than BRT and ridership which has been falling for the last three years ought to finally have an upswing. Ya think?

JH 55 The Penny Parade

The Joe Hill LTD Project
Recently, an employee had a dispute with their pay. This same employee then received a degrading note from Hammbert with an enclosed dollar bill to resolve the dispute in the pay for this employee. But the message was very clear. Mr. Hamm felt he could demean , embarrass this employee for standing up for his/her entitled pay, and for trying to understand the discrepancy. Good heavens let's not ask any questions about out our pay these days - especially in these days of cut-back negotiations from the management. Well rather than ask questions I think it is time for a return message:

Give Hammbert Your Two Cents Worth

TO: The General Manager, Ken Hamm
FROM: A Concerned Employee
SUBJECT: My Two Cents Worth

Mr. Hamm, you recently sent a demeaning note to an employee with a dollar bill enclosed in the envelope. I believe that this act by you is one of intimidation and power and is intended to silence questions. You are creating a hostile work environment and you must be given notice of this problem. I am writing in solidarity for the employee that you chose to pick on.

I obviously cannot sign my name to this message because of your prior record of retaliation against employees. You owe the employee who you did this to an apology and to the rest of us employees a promise not to do it again.

Enclosed is two cents, because I want to do my share and make sure you are not out any money from your very secret big salary.

I think that if Hammbert got a few of these letters with a few cents attached he might just get the message of how inappropriate his actions were. Give your two cents worth.

Before we leave the capital cost of the BRT Pilot Corridor let us also have a quick look at the labor costs per ride using the same assumptions from Joe Hill 54.

The chart above assumes a 4% increase in pay per year and benefit costs of 33% of payroll.  The average labor cost per ride over ten years is:

(Drum Roll Please)...

96 cents per Ride!!
This is why the BRT is wrong.  The capital cost is more than 3 times the labor cost.

Joe Hill LTD Project
LTD Big Cheeses Meet with Register Guard Editors

With a price tag that has gone from just under $9 million to $16 million to now $25 million for the wasteful and mismanaged BRT project what do you think the Editors of the RG will think? Do you think that the LTD Management will have given them this history? Today at $5 million per mile do you think that the LTD big wigs might have had a hard time convincing the Register Guard Editorial Board that BRT was a good idea? One has to wonder, but then maybe the RG will let us know how much wool they had pulled over their eyes. One also has to wonder why Hammbert, Vobora, Gaydos and Ban had to see the RG now? One wonders.

As the Joe Hill LTD Project has shown all of its readers the ridership of the LTD regular system is falling for the last three years. I am sure with the Fall Bid adjustments, that the ridership will likely continue to drop. It is collapsing because of the continued diversion of money from operations to the wasteful green monster - BRT. If a bank was presented a business plan that looked like the BRT for the next ten years on the "pilot corridor" the bankers would laugh them out on to the street.

What is the 10 year capital cost per ride estimated to be for every rider on the BRT? Well we might be able to do a generous estimate so that the big thinkers can weigh it some more.

I think that we were told that a BRT Bus will have seating for 64.

An LTD Route must have 20 boardings per hour to be considered
productive.

We will be kind. We will give them 32 boardings per hour.

Headways I think are projected at 10 minutes. So 6 per hour right?

Weekend Headways might be 20 minutes on average, so 3 per hour.

Service will likely be around 12 hours per day.
It might be more but we will see a reduction in headways if the
BRT runs later. So this makes our number fair when you include the boardings number that we have above. More than fair, in fact.

Weekend Service may not be 12 hours so we will say 10 hours.

These numbers are for work days Monday through Friday, so five days.

There are 52 weeks and weekends per year.

The work week boardings for a year are estimated to be:

32 x 6 x 12 x 5 x 52 = 599,040 week day boardings and
32 x 3 x 10 x 2 x 52 = 99,840 for weekend boardings

(Formula = Boardings x headways x hours of service x per day x weeks per year.)

Total estimated annual ridership:

698,880 total rides

With BRT having a total projected cost of $25 million that is $2.5 million per year over ten years. Capital cost only per ride is

(Drum roll please)

$3.57 per Ride!!

The cost does not include the cost for interest on debt for BRT buses. It does not include the cost of fuel. It does not include the cost of maintenance on the vehicles (or the replacement of vehicles that don't work or burn to the ground. The New Fryer reputation for burning is, shall we say, too recently real.) and it does not include the cost of labor.

Remember we are taking this proposal to a bank for funding our wonderful innovation. They have called the paramedics because the investment officer is laughing him or herself to death. In between laughs, the banker manages to ask why would you do such a dumb ass thing? Hammbert, Pangbert and Viggbert all say in unison because it is faster. We will gain three to five minutes off the route. The banker dies.

Hammbert, Pangbert, and Viggbert leave the bank and say the problem is we need to be faster. (You knew that they would not get it.)

So they pack their bags and they are off to the prairies of Mannitoba to the the New Fast Flyer test drive facility because they know price is no object. The Marketing Manager at New Fast Flyer says don't worry boys, you won't get burned on this one. Trust me.

This is the exchange that Brother Bob Neis and the Joe Hill LTD Project exchanged three days ago in the aftermath of Joe Hill #50. If you don't know what we are talking about read #50. Live in solidarity

>Joe,
>You are right, I misread the sentence. And I don't know who you are as an individual, but as an activist for the 757 members at LTD, you are one of the hardest workers, most diligent researchers for your cause, that I know of. I didn't mean to hurt or rile you up by my "even for you" comment. I do apologize for the comment.

> >Now, about scabs. The term doesn't bother me. I think it is appropriate to use the term when people cross picket lines and perform the work of strikers. And like you, I wouldn't be surprised if Hamm & Pangborn ask admin. people to drive if we're out. And some will do it. And I'll right there trying to stop them.

> >Which brings me to my final thought. You said I don't know you. I say you don't know me very well either. I've been a union officer in the past. 10 years, actually. I stepped down when it was time to let others lead. I've been a proud union member since 1976 and will be one till I die, or retire, whichever comes last. Do you remember the 22 month battle with Phyliss? I was right at the table fighting her all the way. I was never prouder to be a union member. You say that not many drivers get to "hob nob". True. But I have my reasons for being bus stop asst. I can list them if you'd like, but not one of them is so I can hob nob. After almost 28 years of herding a bus around Eugene, I look forward to the days when an extra board driver gets O.T. while driving my work. > >You alluded to the fact that you didn't know if I would stand with my brothers and sisters during a strike. Was that supposed to hurt? I guess you don't know me either.

>In solidarity,
>Bob Neis
>driver

My Dear Brother Neis,

Yes you did rile me. I am sensitive and sometimes rash. It is the passion in me. You are right, I do not know you as well as I should and I prefer to not to make judgements. It was wrong of me to say hob nob or any other characterization of you.

I am aware of your valiant and loyal union work. I did know that you were an officer and leader of this union. I remember the 22 months but only as a green horn with a lot to learn from Brothers like you.

Thank you for your kind words. They mean more to me than you know. Also I want you to know that the four admin employees I named, I like them all. I was not impugning them and I feel I did more to impugn you than I did to them, and for this I am sorry. The Joe Hill LTD Project can be impulsive and mean - but it should never be so against a fellow unionist. I erred in your case.

In Solidarity and embarrassment,

JH 53 Can this be Really True?

Joe Hill LTD Project
Well, here we go. The Joe Hill LTD Project recently received an the following Email. It is disturbing to read. If this is true and not just "rumor mill" stuff that the writer suggests, then the absolute lack of respect for the workers involved is disgraceful. If this is true, then Hammbert is the type that leaves a penny for a tip if he did not like his server. The Joe Hill LTD project would really like to know if this story is true. The project edited out the names of the workers (as shown in red) that this is about to protect their identities. You know who you are if this true. Please drop a line and let The Joe Hill LTD Project know. Here is the Email:

my friend joe,

there is a flap in the payroll area you might want to look into. this is rumor-mill stuff but i've heard it from several folks as of today. A DRIVER rode with me to eugene station each night last bid. HE OR SHE had mentioned to me several times about the fact that HE OR SHE wasn't getting paid for 40 hours/week. it was a very small amount but it was the principle of the thing that upset HIM OR HER. HE OR SHE mentioned the fact that she wasn't getting satisfaction from the usual chain of command. today it was stated that mark johnson and rob montgomery failed to appease HIM OR HER so HE OR SHE went to hammbert himself. HE OR SHE then recieved a dollar, enclosed in an envelope in her mailbox, from hammbert stating,
something to the effect, that he hoped this would make up the difference in HIS OR HER pay discrepancy. it was stated someone else recieved nine cents in a similar fashion. ANOTHER DRIVER related this
story and i'm not sure i've stated it correctly but HE OR SHE was hot over the issue because of the demeaning nature of the response from hammbert. maybe there are others who aren't recieving 40 hours/week as perscribed and just haven't noticed.

Is this story true? The Joe Hill LTD Project does not know. But so everyone can get the same information, it is posted here for your consideration. By the way if you have a payroll issue be sure and let Carol Allred know. Payroll issues are ultimately grievable if they are not resolved and being resolved the way the reader states above is malicious and degrading. Don't let this go by without letting the union know. JH 52 Why the Joe Hill LTD Project

Joe Hill 1879-1915

Joe Hill LTD Project
Why the Joe Hill LTD Project

I have only three reasons to offer for the existence of the Joe Hill LTD Project.

1. The women and men of ATU Local 757 need to have means to hear some of the information that LTD will not tell employees, either by analyzing their own words or dissecting their actions.

2. The need to build a cohesive bargaining unit ready to demonstrate strong solidarity in the face of an employer who has developed a plan to take away our benefits or wages or work rules or union or all of these things.

3. To be a safe place for anyone to answer the information in full anonymity, give their opinions and for the Spirit of Joe Hill to inspire solidarity.

BLOG EXTRA!!! Ham Joins LTD

The Joe Hill LTD Project
LTD Reveals BRT Test Driver Program
Informants to the Joe Hill LTD Project has learned of a new secret plan for LTD.

Ham is Back! Ham made headlines across the world in 1960 by being the first occupant of a Mercury capsule launched into space by the United States. LTD in their quest to look for ways catch the eye of the public in the coming wasteful BRT project have asked the famous chimpanzee to come out of retirement to start test driving the first arrival of the BRT vehicle. By special agreement with NASA, the FTA and LTD and oddly the publisher of Dr. Suess's Children Books (who owned the rights to Ham since the publishing of Green Eggs and Ham.)

Ham Comes out of Retirement

Ken Hamm (no relationship) was gleeful with the announcement. "It is not often that you can get a celebrity and a national hero to take up a cause like BRT." Ham will be our first driver on the BRT system. As you know we have sought a new and different classification for BRT Drivers and this announcement today shows the reasons for this bargaining demand."

Mark Pangborn joined Ken Hamm in welcoming Ham. "I have said for years that trained monkeys could do this job and now I ...I mean LTD will be able to demonstrate that to everyone." "The best part is they are non-union because they are non-human. They don't really have any legal rights except the anti cruelty to animals laws. Those aren't nearly as hard to beat .. I mean... meet as those governing employment of people." LTD is said to be working on a partnership agreement with Green Hill for the housing and maintenance of Ham and his future colleagues.

LTD GM Ken Hamm fore shaddowed that employees will sit up and pay attention to our recruitment of Ham. "We have Mary Neidig calling around to Chimpanzee Rescue and Retirement facilities nationwide in the event of any work stoppage at LTD."

Al Zullo contacted about the plan just revealed by LTD said "Those guys are bananas!" "This is just like all the other management schemes to cut workers and reduce costs at the expense of workers". If this happens we will be filing an Unfair Labor Practice on the never tried inter species infringement theory. "We will go all the way to the Supreme Court on this on," said Zullo. Hamm's response was the same as Ham's response "ooooh, ooooh aaaah, aaaah aaaah ooooh."

JH 51 Why are WE so Passive Instead of Passionate

The Joe Hill LTD Project
Why are WE so Passive Instead of Passionate?

Amazingly, we have our own brand of political correctness these days. Thou shalt not be passionate for fear that someone may misunderstand. Thou shalt not call to arms or warn of your possible demise because that is not possible these days. Oh yeah? Selfishness and passionless understanding of what is at play in our negotiations may render us meaningless and unemployed.

There was a time when the thought of strike breakers (scabs) brought out passion amongst trade unionists. Times were tougher and the workers had to be tougher - because striking in 1903 could get you killed. Striking could result in you being black balled from working anywhere. Striking could result in the break up of your family because of oppressive poverty. Why these hard feelings?

Well a quick history lesson for Joe Hill LTD Project readers.

  • In the 1890's a terrible economic depression raged in the United States as a result of collapsing agricultural prices.
  • Trusts were emerging and taking control of the economy of America if not the world (sound familiar i.e. OPEC and the WTO)
  • Socialism/Populism/Direct Democracy was springing up in direct response to the Trusts
  • The depression ends with the Spanish American War in 1898
  • Industrialization modernizes and mass production is off and running - the economy is changing - bringing confusion and conflict to labor markets/
  • Unions begin to spread to factories from their traditional AFL craft and transportation niches and you see the birth of the CIO.
  • Populism grows - several states (including Oregon) adopt common populism positions - such as direct democracy by initiative petition.

Passion was necessary or die, quite literally. So SCAB is a deeply complicated and passionate word. It is loaded word without a doubt. The times were different then... or were they. Maybe the times are too much the same but the names have been merely changed. But the economic agenda remains the same...suppression of the workers and removal of democracy from the workplace. It is time to get passionate again.

A world famous, respected and loved American author wrote the following words about SCABS. (This is a historical speech by someone else NOT the Joe Hill LTD Project and is intended to demonstrate the passion that once flowed in the American Labor Movement. The Joe Hill LTD Project embraces the passion of these remarks.)

"After God had finished the rattlesnake, the toad and the vampire, he had some awful stuff left with which he made a SCAB. A SCAB is a two-legged animal with a corkscrew soul, a waterlogged brain, and a combination backbone made of jelly and glue. Where others have hearts he carries a tumor of rotten principles. When a SCAB comes down the street men turn their backs and angels weep in heaven, and the devil shuts the gates of hell to keep him out. No man has a right to SCAB as there is a pool of water deep enough to drown his body in, or a rope long enough to hang his carcass with. Judas Iscariot was a gentleman compared to a SCAB. For betraying his master he had the character to hang himself. A SCAB hasn't. Esau sold his birthright for a mess of pottage. Judas Iscariot sold his Savior for thirty pieces of silver. Benedict Arnold sold his country for a promise of a commission in the British Army. The modern strike breaker sells his birthright, his country, his wife, his children and his fellow-men for an unfulfilled promise from his employer, trust or corporation. Esau was a traitor to himself, Judas Iscariot was a traitor to his Lord, Benedict Arnold was a traitor to his country.

A STRIKE BREAKER IS A
TRAITOR TO HIS
GOD, HIS COUNTRY, HIS FAMILY AND THE
WORKING CLASS"

Joe Hill responds to Bob Neis

>Joe,

>Why would you name Ruth Linoz, Will Mueller, Marcia, and Steve Rayack as scabs or potential scabs?

>Because they were drivers at one time? Most of our supervisors were at one time drivers. These people are honorable, hard working individuals. To impugn these people's good name is a low blow, even for you.

>I hope you have the integrity to apologize at a later date. I doubt very much if these people would do anything to hurt our cause. You may not know this but Will was the impetus for trying to organize the admin. people a few years back.

>Bob Neis

>LTD driver

Joe Hill Responds to Brother Neis

"A low blow even for you"? Well I guess that was supposed to hurt me. You may feel free to comment on the remarks or statements made by the Joe Hill LTD Project, but do not think you know anything about me, or who I am. One thing is certain you do not know the Joe Hill LTD Project.

Most drivers don't get to sit in admin offices and hob nob with the very people who might take our jobs when when we agree to follow the union in a strike if that happens. Supervisors, contractors or even other admin employees with CDL's that try to do our work if we are on strike are scabs simply by definition. You must not like the term scab and perceive it as an insult. We don't know if you will strike if called upon or be a scab. But anyone who does our job either willingly or unwillingly (because they are ordered to) would be a scab. To be clear though for you, if I had accepted an administration job and still had a CDL, the choice is already made and I would obey the orders of the bosses. What choice would a person have? Obey or be fired? That is no choice. What protection do they have? They have no contract?

Also you did not read the article very carefully. The sentence that upset you reads -

"LTD is counting on scabs, supervisors, and workers
like Ruth Linoz, Will Mueller, Steve Rayack, and Marcia Mafei to scab on us
too."

As you can see the construction of this sentence is an indictment on LTD not the employees or supervisors. If you think that LTD will give Ruth, Will, Steve or Marcia a choice in the question if they attempt to maintain service in a strike then you know nothing of the people for whom you are working. Some of these people will be ordered or may even willingly agree to drive shifts if we go on strike. If they do they will be scabs and forced scabs simply by definition. Do you think it is any secret about who has CDL's among admin employees?

If you choose to work during a strike, Brother Neis, then you will be a scab. The choice is yours. I have not impugned them. You are simply incorrect. Also they are all quite able to speak for themselves. If they need an apology or explanation I will be happy to provide it to them at their request. They are lucky to have friends like you to look out for them even when nothing malicious was extended to them.

I have raised concerns about LTD. I do not trust LTD. I do not trust our bosses or the Board that is leading this organization to what appears more and more like a strike creating strategy.

In Solidarity,

Joe Hill
